The and/or is interesting here
“However, if the salary cap director concludes that a breach has occurred, he shall charge the club (and/or player, club official, agent) and this charge shall be made public.”

A passing thought;
There seems to be a lot of people posting ‘the new’ regulations/punishments but what was written of old, and is it not those that apply?

Is this why high profile players are leaving? they don't want to play in the championship?

There’s no relegation/promotion for a while now it’s a closed shop so I would be very surprised if we were relegated regardless of how serious it is.

Re: New Salary Cap Breach?
Do we know why Tigers have come out and stated that they are being investigated when it would have been less worrying for all if they had kept quiet until the outcome was known ?
Also do we think that it is a disgruntled former player that has opened this can of worms ?

Good PR,it would’ve leaked anyway so looks like we have nothing to hide. Re: New Salary Cap Breach?
I'm guessing the Times either asked us for a comment on it or we were given the heads up it was about to be published so got a statement out first. That story by the Times was certainly not written from scratch after the statement.ay2oh wrote: ↑Wed Dec 29, 2021 10:06 amOnly after we made a statement that we were being investigatedTigerFeetSteve wrote: ↑Wed Dec 29, 2021 10:02 amI thought the Times article named usay2oh wrote: ↑Wed Dec 29, 2021 9:48 am Do we know why Tigers have come out and stated that they are being investigated when it would have been less worrying for all if they had kept quiet until the outcome was known ?

Re: New Salary Cap Breach?
Interesting bit
Tony the tax planner
Millions of pounds of Ole Gunnar Solskjær’s image rights income from Manchester, also went to a company in Derby.
“WIMC is one of the leading sports rights management and consultancy businesses in the UK. It also has a global network of associates at its disposal to assist in the delivery of its services,” claims Worldwide Image Management Corporation on its website.
The company advises “professional sports clubs, players and rights holders on the management and exploitation of their commercial rights.”
A business park across the road from Derby County’s home ground Pride Park houses WIMC, along with a number of other entities – among them several companies owned by Scandinavian footballers.
Not only do these entities share the same address, another common denominator is Anthony John “Tony” Lymn. He’s a director of several of the footballers’ companies, and owns 50 per cent of WIMC.
“I split my time between my corporate clients, my sports clients and one-off projects for the firm’s clients. The variety in work is both challenging and rewarding. Everyday brings something different and I regard myself as a ‘problem solver’ as well as an advisor,” he states on the web pages of his accountancy firm Ashgates.
”Within the world of Professional Football and Rugby I am ‘Trusted Advisor’ to Players (particularly Non-UK Domiciles) and one of the country’s leading Sports Tax Specialists.”

We’re guilty until proven innocent…that’s the way these things go sadly.
Re: New Salary Cap Breach?
For those on twitter, seek out a user called "rugby and the law" - very useful synopsis of the current situation
For those not - key points this user raises
* There is a 5 year limitation period, so if there was a breach in the 16/17 season, they have until 30 June 2022 to bring a charge
* Regulations in force at the time will likely apply, not the current ones as a result of the Myners report after Saracens
* The harsher sanctions brought in after Myners report unlikely to apply providing the breaches (if there are breaches) are not current. if the breaches exists post Myners report and rule changes, then the new harsher sanctions can apply
2 things for me
(1) Need to confirm there has been a breach
(2) and if above is yes, when? and how serious?
Final point - what a mess!!!

Thanks Bunchy - a useful summary. I can never figure Twitter out!
Re: New Salary Cap Breach?
With the Sarries and Itoje image rights issue you can see how hard it is to value them. The fact the enquiry went against the value given by a company that are their own auditors shows how muddled it got.
If a player is negotiating a deal and there is a set amount to spend direct salary is taxable under PAYE rates. If the agent argues that the payment could be into a company for image rights the total may be the same but the reduced rate of corporation tax would apply. If this over valued the image rights would that be a salary cap breach as the net salary would be higher but the gross package and cost to the club would be the same. England fringe players would be the hardest to value in a prospective negotiation. I can see Maro’s image will sell stuff to a wide audience, not bought any more Dove shower cream since Lennie’s advert though . It was interesting that LTTV had some on the young lads (JVP, Whitcome, Chessum, Reffell +1 other) doing a darts game with pro darts players sponsored by a sponsor. I suppose that gives them rights over those images and a value?
