I doubt that any player contract has a confidentiality clause that protects against the employer announcing that an employee has not agreed a new contract. Day in, day out, you read in the news that sportsperson X has not agreed a new contract and I'm pretty sure the clubs don't get sued for it...
The media are clutching at straws to sell a few more advertising clicks from this subject, take it with a pinch of salt.
The lawyer quoted in the Times benefits from agreeing to say something "newsworthy". He may be a real lawyer, but he doesn't have access to Tigers' contracts so he is merely speculating.

If I were one of the players I wouldn't see much value in that part of the offer. It's like being promised a bonus for achieving something that you cannot control, and the people who can control it (the board) are in certain circumstances now incentivised not to achieve it.

Whatever they did, it appears to have worked because they didn't lose anyone. Even if a few players a bit grumpy about it, it's still a success.
