I managed a quick glimpse just before it mysteriously disappeared. There was one interesting point I thought in that he said that the allegations concerned events before he joined the club.

The gist of the abstract was a published quote suggesting most as opposed to all occurred before his tenure. A critical chronological statement.

Former Leicester recruitment boss Jan McGinity has had his say on the current Premiership Rugby salary cap investigation into historic image rights payments at the Tigers that could ruin their fantastic 2021/22 season where they are leading the league in England and flying high in the Champions Cup.

The recent restoration of Leicester as a powerhouse in the English game has been one of rugby’s most gripping stories in recent times, but this progress has now been threatened by the potential ramifications of a freshly launched investigation into alleged historical off-the-books payments made to players.
It was December 28 when Leicester confirmed they had met with Premiership officials to discuss the potential salary cap regulation breach that is being investigated by Andrew Rogers, the tournament’s salary cap director.

The issue relates to Leicester’s association with Worldwide Image Management which was shut down last year but it had apparently made payments in the past to Tigers players. An official club tweet posted last month stated: “Leicester Tigers are aware of allegations made against the club regarding historic image rights payments.

“The club is cooperating with Premiership Rugby, who are looking into the historic matter, and has met with representatives from Premiership Rugby to discuss the claims.”

Cap boss Rogers is looking to clarify whether the payments constituted an increase in individual salaries, thereby breaking the salary cap and opening Leicester up to punishment if found guilty. Saracens, the last club to fall foul of the salary cap, wound up automatically relegated to the Championship for a year, but there is no indication regarding what might happen to Leicester if it is proven they have done something wrong.

Watching on from afar has been McGinity, who was head of elite performance recruitment at Leicester from the summer of 2019 through to February 2021. He was at the forefront of the contracting overhaul that now has a much-changed Leicester thriving under Steve Borthwick following successive eleventh-place Premiership finishes.

Having been made redundant by Leicester, McGinity has since gone on to become the founder and director of Rugby Coach Management (RCM), an agency specialising in the contracting and recruitment of coaches, and as part of an in-depth, soon-to-be-published interview with RugbyPass on his two-decade career working in the business of rugby, he shared his thoughts on what he makes of the Tigers salary cap investigation.

“A lot of it precedes when I arrived,” said McGinity, the ex-Leicester contract supremo. “The reality is that obviously, the rules changed as a consequence of the Saracens investigation. It’s hard to know because if you are going off what used to be accepted from a commercial perspective up until it was really clear into black and white around what is the commercial value off the field for an individual athlete and who is willing to ascertain that value and if there were rights that were held by a third party and someone else is paying that money and it is not coming directly from the club, is that illegal? I don’t know.

“It’s that kind of grey area where people are still trying to qualify that. Ultimately what they [Premiership Rugby] want to do is make sure there is no place to hide moving forwards, that there are no grey areas, that it’s black and white, this is what is accepted, this is what is not and it is all in the cap or it is not so there is no other payment that can come in for the individual which I get.

“Andrew Rogers wants to make sure that moving forward from a reputational perspective for the league that there is nothing historic going to come up and slap them on the :censored:. They are making sure that even if it was historic that it was recognised this went on and this practice needs to stop and we need to start a new chapter.

“Without having any of the information and knowing what is going on in the investigation it is hard to know what exactly they are looking for, but also what rules they are assessing it under and also whenever the potential offences might have occurred or if there were offences.

“Do you take the rules from that specific time (of the alleged offences)? Do you apply the new rules to it? Does that mean there is a financial penalty as a consequence of that and also potentially points? Does it mean the individuals involved can be prevented from working in rugby for a period of time?

“It’s really tough to know what they are going to use and then actually how are they going to assess it. It’s one of those that you just watch from afar and see how things progress but I don’t envy Andrew Rogers because I am sure it is pretty hard to go through all that information to try and put it all together. It would be a shame if they [Leicester] got a penalty in points at a time they are actually doing well in the league.”

Couple of points from the Egerton Welford Road Weekly

1. Seems like 3+ years are under investigation.

2. Cumulative overspend they're suggesting is over ½ million but less than even just the £800,000 overspend on Itoje (let alone their other breaches)

3. It's looking like points deduction is unlikely as amount of overspend per season is unlikely to meet the threshold £200,000 at which points deductions are implemented.

4. All of the above is supposition, as nothing is confirmed (but knowing Egerton likely to have some pretty reliable sources to say some of this)

It looks like we are co operating with the right parties in this investigation. I'm sure a club with the culture and standing of Tigers can't be involved in in such a grubby and sordid claim? We are better than that aren't we ?If the timescale going back to 2019 is accurate then our current Chairperson and current CEO were in senior positions at that time and can put our position clearly to Prem Rugby. Once this is done PR will see the matter is closed and has no grounds .

£309,841.06 in fines and taxes. Not sure if that comes out of general turnover or salary cap.

Where does the fine/tax money go to?

Is there anyone at the club now who was in a position to know this was occurring, or was party to these arrangements?

The most important thing is we have been open & accepted the findings.

Might be worth the Salary Cap Manager checking the other 12 clubs in relation to this type of arrangement.
To win is not as important as playing with style!

General turnover, otherwise it could mean we're outside the cap in the future

Excellent question I would assume any unpaid taxes go to HMRC and the fines to premier rugby
